|The following Terms and Conditions of Sale should be read before making an order
from this website. These Terms and Conditions of Sale constitute a legal agreement between you and The BlackBoxCameraTM Company Limited. By ordering
from this site you indicate that you have read these Terms and Conditions of Sale and that you agree to be bound
by them. These conditions do not affect your statutory rights.
Please note that there are no circumstances under which The BlackBoxCameraTM Company Limited will accept orders made outside these terms and conditions. Representatives of companies or institutions which have their own terms and conditions governing the orders they make from suppliers must have these waived in writing prior to ordering from us. Do not send purchase orders or other documents without prior reference.
Order acceptance and the completion of the contract between you and The BlackBoxCameraTM Company Limited will take place on the dispatch of the products ordered by you. No other action or communication prior to the dispatch of the products ordered should be taken to indicate order acceptance. The Company may decline to accept your order for reasons including but not limited to the following:
* Our inability to obtain authorisation for your payment
* The identification of a pricing or product description error
Good communication is the foundation of effective customer service. We have tried to make this website as easy to use as possible with clear descriptions of all products on offer, but obviously we cannot anticipate all the questions you might have. Therefore please contact us before you place an order if you would like any more information directly related to your intended application. We ask that you direct all your enquiries to us via email at firstname.lastname@example.org in the first instance as this allows us to provide the most comprehensive response to you. If you wish to make an order using a credit card please do so from this website using the WorldPay secure online ordering system. Card details given to us by phone will be processed via this system. Therefore if you do not wish your card details to be processed via the internet please do not phone them through to us. You will be informed of the progress of your order by email. Therefore you must provide us with a valid email address that is regularly monitored when you make your order.
All information gathered from customers in the normal course of our business is held and used in accordance with the guidelines laid down in the General Data Protection Regulation (GDPR). Your data is not passed on to anyone else and you will not be contacted further if you make an enquiry. No customer data is held on our website. This means that your credit card details are never stored on a system where they could be accessible by a third party.
As a customer of The BlackBoxCameraTM Company Limited we process your personal data, this may include: contact details, payment details (excluding credit card details), IP address, geographic and location data. Our lawful basis for processing this data is our contract with you and our legitimate interest in marketing our goods and services. We process this data to negotiate a contract of sale, to fulfil that contract and for marketing of related goods and services. We may transfer your data to our suppliers, for example couriers, as necessary to fulfil our contract. We may retain this data for up to 6 years from our last transaction in accordance with our legal obligations (e.g. the Finances Act 2008). You have the qualified right to request: access to and port your data, rectification or erasure of the data, restriction of processing or to object to the processing. You also have a right to lodge any complaint the Information Commissioner's Office.
All prices are current at the time of publication, errors & omissions excepted. We reserve the right to change prices at any time without notice. In the event that a product is listed at an incorrect price due to an error in pricing, The BlackBoxCameraTM Company Limited shall have the right to refuse or cancel any orders placed for that product, even when the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, The BlackBoxCameraTM Company Limited shall issue a full refund to your credit card account immediately.
All items for sale on this website are priced in UK Pounds Sterling (GBP). If you pay by credit card you may choose to have your credit card billed in US$, Euros or Australian dollars. The actual exchange rate used will be taken from the WorldPay secure server at the time you make your order and your credit card will be billed in the currency of your choice. A minimum shipping and handling fee of £3.00 is charged for all orders. The correct shipping and handling zone, either UK, EU or World must be selected at the time your order is made. If the shipping and handling charge is not correctly calculated for your order's destination you will either be refunded or asked to pay the difference prior to the dispatch of the order.
Payment is accepted by credit card.
All photographs and images are for representation purposes only. No guarantee is given of the availability of any goods in this electronic publication. We reserve the right to change specifications or supply improved products where an original item is unavailable.
Shipping and Delivery
All items displayed for sale on this website are in stock and available for purchase. Our products require configuration and testing prior to shipment. Therefore there will be a lead time between your order and the shipment of your purchase dependent on how busy we are and the size of your order. You will be informed of the lead time to dispatch when we receive your order. Goods are normally dispatched within 10 working days. In exceptional circumstances the lead time to dispatch can be up to 20 working days. If for any reason it is anticipated that we will be unable to to dispatch an order within 20 working days you will be informed and given the option to cancel your order and receive a full refund immediately. We are not just in time suppliers. If you require an item by a certain date or within a certain time period please contact us before you make your order.
For orders made by credit card the name and address for delivery must match the billing address held by the card issuer.
Within Great Britain goods are shipped by Royal Mail recorded or special delivery services. Goods for international delivery are dispatched by either registered small packet airmail or courier parcel service as appropriate. A signature will be required on delivery in all cases. Please ensure you select the correct shipping zone in the shopping cart when you make your order.
No claim for loss in transit can be made until 30 days after dispatch. Any shortage or damage found on delivery must be reported within 3 days of receipt of goods. Parcels should always be signed for and where goods arrive damaged, packing materials should be retained pending inquiry and inspection. Any claims for damage or shortage which are not notified to the Company within the time limit will not be accepted.
Return of goods
Goods are not sold on a trial basis. Customers should check specifications and suitability prior to ordering. Customers returning goods without fault will be subject to a 20% restocking fee. Goods may not be returned for replacement or credit without prior approval. If you wish to make a return contact The BlackBoxCameraTM Company Limited immediately by email stating your reason. A Return of Merchandise Authorisation (RMA) number will be allocated which must be clearly marked on your return packaging. An immediate replacement will be made for any returned item found to be faulty where liability for the fault does not lie with the customer. If the fault is due to action by the customer such as, but not limited to, improper installation, misuse, failure to follow installation and operating instructions, alteration, abuse, accident or tampering, or other such that the manufacturer's warranty shall be void, the customer shall be liable for the full value of the order.
Order Cancellation. Customers in the EU have the right to cancel their order for up to seven days after the goods are delivered provided the goods are unused and are returned in a condition fit for resale. The seven day period is specifically defined under the EU distance selling regulations as a cooling off period to allow the order to be cancelled. It is not a trial or evaluation period. Used items that are returned will be subject to the restocking fee.
The BlackBoxCameraTM Company Ltd. warrants its products to be free of defects in materials and workmanship under normal use and service for a period of twelve months from the date of original purchase. The obligations of The BlackBoxCameraTM Company shall be limited within the warranty period, at its option, to repair or replace the product or any part thereof. The company shall not be responsible for dismantling and/or installation charges. To exercise the warranty the product must be returned carriage paid and insured. Under this limited warranty the maximum liability of The BlackBoxCameraTM Company shall not in any case exceed the purchase price of the product, which shall be fixed as liquidated damages and not as a penalty, and shall be the complete and exclusive remedy against The BlackBoxCameraTM Company.
This warranty does not apply in the following cases: Improper installation, misuse, failure to follow installation and operating instructions, alteration, abuse, accident or tampering, and repair by anyone other than The BlackBoxCameraTM Company.
The BlackBoxCameraTM Company Limited specifically disclaims any suitability of its products for any particular purpose. It is the responsibility of the buyer to determine the suitability of any product for their purpose prior to any use that may result in financial loss, death, personal damage and/or damage to property. Therefore the BlackBoxCameraTM Company Limited will not be held liable for any loss or damage which may occur due any of its products being found unsuitable for a given application.
Neither party shall be liable for any default due to any act of God, war, strike, lock-out, industrial action, fire or other event beyond the reasonable control of either party.
This Agreement shall be subject and construed according to the English Law and parties agree to accept the jurisdiction of the courts of England, whose courts shall be the courts of sole jurisdiction in relation to this Agreement and any disputes arising out of it.
Unless given in writing, no action of The BlackBoxCameraTM Company Limited may be construed as waivering or amending these Terms and Conditions. This Agreement may not be varied except by an instrument in writing signed by all the parties to this Agreement.
The BlackBoxCameraTM Company Limited reserves the right to amend these Terms and Conditions, and the content of this website including software licence terms, pricing, captions and any other information without notice.
